We have succeeded in securing a range of different therapies for children, depending on the child’s needs. Some children (particularly those with Autism) require Speech and Language Therapy, Occupational Therapy and Sensory Integration Therapy incorporated into their school day. The benefits of Sensory Integration Therapy are not always recognised by Local Authorities, but often Sensory issues need to be addressed before a child can benefit from other provision provided in a statement.
There is a great deal of case law and guidance given by the SEN Code of Practice which deals with the way in which statements of SEN should be written. Authorities often issue statements which are very vague and the provision is not specific enough. We advise parents whether their statement is appropriate for their child.
The law states that once an authority has made a statement of special educational needs it must maintain the statement. By this it means every bit of the statement should be followed. Often we are asked to advise parents who are concerned that a certain provision is not in place. Unless the provision is specified clearly in the statement it is not possible to enforce it.
When we advise parents in relation to their statement of special educational needs we always ensure the statement is improved so that it is drafted as tightly as possible. The law requires this but time and time again authorities try to avoid it.
When reading a statement we always suggest parents ask the questions Who, When and How, What and Where.
- WHO is providing the support/therapy?
- WHEN and HOW often the support is to be provided?
- WHAT precisely is the support or therapy?
- WHERE is the support therapy to be provided?
Often the school named in Part 4 of the statement is not considered appropriate and cannot meet the child’s needs. We advise whether an Appeal to the Special Educational Needs and Disability Tribunal is appropriate. Any appeal must be brought within 2 months of the date of the final statement. We advise parents at each stage throughout the Tribunal process.
